THE FOLLOWING SWEEPSTAKES IS OFFERED IN THE UNITED STATES AND THE DISTRICT OF COLUMBIA (“D.C.”).  DO NOT ENTER THIS SWEEPSTAKES IF YOU WERE NOT SEVEN (7) YEARS OF AGE OR OLDER AS OF 9/15/2009 AND  IF YOU ARE NOT A LEGAL RESIDENT OF AND CURRENTLY RESIDING IN THE UNITED STATES OR D.C. THIS SWEEPSTAKES WILL BE GOVERNED, CONSTRUED AND EVALUATED ACCORDING TO IDAHO LAW.

ELIGIBILITY: This Sweepstakes is open to legal residents of the United States and the District of Columbia who were 7 years of age or older as of 09/15/2009. Employees of Sponsor, Idaho Potato Commissioners, and agencies, agents and employees of the State of Idaho and all other service agencies involved with design, execution or fulfillment of this Contest, and members of the immediate families (defined for these purposes as parents, children, siblings, and spouse) or households (whether related or not) of any of the above are NOT eligible to enter or participate in any manner.
PROMOTION PERIOD: The Promotion begins at 12:01 a.m. Eastern Time ("ET") on September 15, 2009 and ends at 11:59 p.m. ET on November 20, 2009 (the "Promotion Period").

HOW TO ENTER: During the Promotion Period, go to http://www.www.idahopotato.com (“Website”) and click on the link to locate the “Idaho Potato Harvest Game”.  Watch the short,  animated video and play the memory game.  Upon completion of the game, you will be asked to enter sweepstakes.  Follow the on-screen directions, complete all required registration fields and submit to enter. (“Online Entry”). Entrants must complete all required information. LIMIT ONE (1) ONLINE ENTRY PER PERSON/E-MAIL ADDRESS.   

GRAND PRIZE DRAWING: On or about 12/15/09 a random drawing will be conducted from among all eligible Online entries received during the entire Promotion Period.

PRIZES, APPROXIMATE RETAIL VALUE (“ARV”) & ODDS: One (1) Grand Prize: $10,000 which will be divided between the Sweepstakes winner ($5,000) and a school of his/her choice.  Sponsor will donate $5,000 to winner’s school listed on the entry form. Total ARV of prize is $10,000. No substitution or transfer of prizes is permitted except at Sponsor’s sole discretion. If a prize, or any portion thereof, cannot be awarded for any reason, Sponsor reserves the right to substitute a prize of equal or greater value. All federal, state and local taxes, and all other costs associated with acceptance or use of the prizes, are the sole responsibility of the winner (or if a minor, his/her parent). Arrangements for delivery of prizes will be performed after winner validation. Odds of winning any prize depend on the number of entries received. Winners will be notified by email or, if noted under “Optional” by telephone on the Sweepstakes Entry Form. Unclaimed prizes will not be awarded.

PRIVACY INFORMATION: Online contact information will be collected from entrants for the sole purpose of a direct one-time response to contact sweepstakes winner, and will be destroyed at the conclusion of the sweepstakes.

GENERAL TERMS & CONDITIONS: The potential Winner will be notified by either email or telephone outreach.  All legal responsibilities under the Rules of a minor (as defined by state of primary residence) will be assumed by a parent/legal guardian (“Parent”); If Grand Prize is won by a minor, it will be awarded in the name of the Parent. If a potential Winner is an eligible minor, a parent or legal guardian must sign and return all documents required for verification.
These documents will be forwarded to the potential Winner via overnight mail.  Potential Winner (or parent/legal guardian if potential Winner is an eligible minor) must execute and return an affidavit of eligibility, liability release and publicity release, and documents satisfactory to Sponsor within ten (10) days of receipt of notification or prize will be forfeited and an alternate potential winner will be selected on the basis of the criteria stated above.

The return of any prize/prize notification as undeliverable or failure to return any documents in a timely manner may result in disqualification and an alternate winner may be chosen. By participating, participants agree to release, discharge and hold harmless Sponsor from and against any and all liability or damages associated with this Promotion or acceptance, use or misuse of any prize received in this Promotion. Sponsor is not responsible for any typographical or other error in the printing of the offer or administration of the Promotion. Acceptance of prize constitutes permission for the Sponsor and its agencies to use winners’ names and likenesses for purposes of advertising and publicity without further compensation, unless prohibited by law. By participating in this Promotion, participants agree to be bound by the Official Rules and decisions of the Sponsor, which shall be final in all matters relating to the Promotion. In the event of a dispute regarding the identity of the person submitting an entry, entries will be declared made by the person's name submitted at time of entry. Sponsor reserves the right to disqualify any individual who tampers with the Promotion or Website or acts in a disruptive manner. This Promotion is offered only in the United States and is governed by the laws of the State of Idaho. By entering, entrants irrevocably consent to the sole and exclusive jurisdiction of the courts of the State of Idaho located in the county of Ada for any action, suit or proceeding arising out of or relating to this Promotion.

LIMITATIONS OF LIABILITY: In the event of a dispute regarding the identity of an entrant, the corresponding entry will be deemed to be made by the authorized account holder of the email account from which the entry was submitted. Neither Sponsor nor its agencies are responsible for lost, interrupted or unavailable satellite, network, server, Internet Service Provider (ISP), Website or other connections availability, accessibility or traffic congestion, or miscommunications, or failed computer, network, telephone, satellite, or cable hardware, software or lines, or technical failure, or jumbled, scrambled, delayed, or misdirected transmissions, or computer hardware or software malfunctions, failures or difficulties, or other errors of any kind whether human, mechanical, electronic or network, or the incorrect or inaccurate capture of entry or other information or the failure to capture, or loss of, any such information.

Neither Sponsor nor its agencies are responsible for any incorrect or inaccurate information, whether caused by Website users, or by any equipment or programming associated with or utilized in this Contest and assume no responsibility for any error, omission, interruption, deletion, defect, or delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or tampering with or hacking of Website. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds may be tampering with the entry process or operation of this Contest or Website, or may be acting in violation of the terms of the Website, or may be acting in a non-sportsmanlike or disruptive manner, or with intent to threaten, abuse, or harass any other person. Any attempt to deliberately damage any Website or undermine the legitimate operation of this Contest may be unlawful and subject to legal action by Sponsor or its agents.

WINNERS LIST: For the winner’s name, send a self-addressed stamped envelope after 11/15/2009 to: Idaho Potato “Idaho Potato Harvest Game” Sweepstakes Winner, 829 De La Vina Street, Santa Barbara, CA 93101. Requests must be received by 1/31/10. Winner’s name and school donation information will be sent after winner has been verified.

WAIVER: By participating in this Promotion, participant waives all rights to claim actual punitive, incidental and consequential damages, attorneys’ fees or any other damages from sponsor.
